Contact is offensive if it offends the personal dignity of an ordinary person who is not unduly sensitive. If the contact is not harmful, the plaintiff can still recover under the objective standard of the reasonable person test. Again, the test is whether a reasonable person, a person who is not unduly sensitive, would be offended by the contact. However, if the defendant knows that a plaintiff is unduly sensitive and exploits those sensitivities, then he will be found liable for the consequences of the harmful and offensive contact.

To begin to establish a tort of battery, there must first be an act by the defendant that leads to contact with the plaintiff’s person. An act is a voluntary movement of the body. A person decides to physically move his or her body so as to cause it to do something. It is a conscious decision to act. Not all harmful or offensive contacts are the result of acts. In order to determine whether or not the contact was harmful or offensive, the court will look to the reasonable person test. Would a reasonable person of ordinary sensitivity consider the contact harmful or offensive?
